Introduction

This Copyright Notice explains the ownership, permitted use and protection of content associated with Fight My Monster ("FMM", "we", "our" or "us").

Fight My Monster respects intellectual property rights and expects users, contributors and community members to do the same.

Project Independence

Fight My Monster is an independent project inspired by the Fight My Monster game that operated between 2011 and 2016.

Fight My Monster is not affiliated with or endorsed by any former owners, operators, publishers, developers or rights holders associated with that game.

Copyright Ownership

Copyright and other intellectual property rights in Fight My Monster content may belong to members of the Fight My Monster team, authorised contributors, licensors or other rights holders.

Ownership may vary depending on the content, creator, contributor agreements, licences or applicable law.

Nothing in this notice transfers ownership of intellectual property unless expressly stated in writing.

Protected Content

Unless otherwise stated, the following content is protected by copyright, trademark and other intellectual property laws:

  • Logos and branding.
  • Monster designs and characters.
  • Artwork and illustrations.
  • User interface designs.
  • Website content.
  • Written materials and documentation.
  • Game assets and visual elements.
  • Promotional graphics and media.
  • Software, systems and source code.
  • Audio, visual and multimedia content.

Protection applies whether content appears on the website, game services, social platforms, Discord server, promotional materials or other official Fight My Monster services.

Ownership of Submitted Content

Unless otherwise agreed in writing, submitting content to Fight My Monster does not transfer ownership of that content.

Any rights granted to Fight My Monster are limited to the licences described in this notice, the Terms of Use or any applicable contributor agreement.

User-Created Content

Community members may create and submit artwork, monster concepts, event entries, feedback, suggestions, written content and other materials.

Unless otherwise agreed in writing, creators retain ownership of their original work.

Contributors represent and warrant that they own the submitted content or otherwise possess the necessary rights, permissions and authority to grant the licences described in this notice.

By submitting content to Fight My Monster, contributors grant Fight My Monster a worldwide, perpetual, irrevocable, royalty-free licence to use, reproduce, modify, adapt, display, publish, distribute and incorporate submitted content into services, events, promotional materials and game-related content.

This licence survives account closure, service termination or withdrawal from the community.

Contributor-Created Content

Content created by members of the Fight My Monster team or authorised contributors may be subject to separate agreements, permissions, licences or ownership arrangements.

Ownership and usage rights relating to contributor-created content may be governed by contributor agreements, project policies, licences or written permissions.

Third-Party Content

Certain content, services, trademarks, platforms, software or assets referenced by Fight My Monster may belong to third parties.

Examples may include:

  • Discord.
  • Patreon.
  • Social media platforms.
  • Hosting providers.
  • Analytics providers.
  • External software providers.
  • Third-party trademarks and brand names.

All third-party content remains the property of its respective owners.

Nothing in this notice grants ownership or rights over third-party intellectual property.

Permitted Use

Subject to compliance with applicable laws and Fight My Monster policies, users may generally:

  • Access and view content for personal use.
  • Participate in community discussions.
  • Share official links to Fight My Monster resources.

Restricted Use

  • Redistribute protected assets as standalone files.
  • Sell, licence or commercially exploit Fight My Monster content.
  • Modify and redistribute protected assets.
  • Claim ownership of Fight My Monster content.

  • Use Fight My Monster content in a manner that suggests official endorsement or affiliation.

All rights not expressly granted under this Copyright Notice, the Terms of Use or applicable law are reserved by the respective rights holders.

Fan Content Guidelines

Fight My Monster supports community-created fan content, including artwork, videos, livestreams, reviews, guides, screenshots and other creative works.

Fan content is generally permitted provided that:

  • The content is created in good faith and does not primarily exist to sell, licence or commercially exploit Fight My Monster intellectual property.
  • Appropriate credit is provided where reasonable.
  • The content does not falsely claim official status.
  • The content does not damage the reputation, integrity or safety of the project.
  • The content complies with applicable laws and platform rules.

We reserve the right to object to uses that are misleading, harmful, unlawful or otherwise inappropriate.

Trademarks and Branding

Names, logos, branding elements, visual identities, slogans and associated branding materials used by Fight My Monster may be protected by trademark, copyright, common law rights or other legal protections.

Use of Fight My Monster branding does not imply ownership, endorsement, partnership, sponsorship or official affiliation unless expressly authorised.

Attribution Requirements

Where attribution is required, users should provide reasonable acknowledgement of the original creator, rights holder, project, licence or source material.

Additional attribution requirements may apply to specific content, licences, contributors, events or submissions.

Providing attribution does not grant permission to use content where permission would otherwise be required.

Attribution requirements do not limit any ownership rights held by the original creator or rights holder.

Archiving or preservation does not alter ownership rights unless otherwise agreed in writing.

Relationship to the Terms of Use

In the event of any conflict between this Copyright Notice and Terms of Use, the Terms of Use will take precedence unless expressly stated otherwise.

Changes to This Notice

We may update this Copyright Notice from time to time.

Updated versions become effective when published on our website unless a different effective date is specified.

Where changes are material, we may provide additional notice through our website, services or other reasonable means.

Continued use of our services after the effective date of an updated Copyright Notice indicates acknowledgement of the revised Copyright Notice.
